What does Royalty Free mean?

To help you understand what it is, the first thing is to look at the problems and then avoid them. As a songwriter or music producer using music without the proper clearance is very risky. The chances of ending up in legal trouble regarding copyright infringement brings with it hassle and expense.

For example, as you are creating your song you decide to use a sound sample from a well know song as part of the music. In order to use that sound sample you need to get permission from the copyright owner. They have the option of granting permission to use it or they can deny the use. If they do allow you to use they will issue a license that will allow you to use the sample.

This can take a lot of time and money to get done. On top of that you will have to pay a “per use” fee. This means that if the sound sample is used 3 times in your production you pay 3 times. If your song gets played on the radio you will also have to pay 3 times also. To get around this Royal Free Music libraries provide music samples and loops with a “pre-license”. This method gives you permission to use the sample as many times as you want and not pay additional fees.

  1. Hello i have a question, i been using loop master for sometime i have not released anything with loops from there yet but dose it means when i sign up for loopmasters and purchase packs that that is the license agreement or do i need to go further to inquire a license for them to release it? I noticed you’re mentioned a one-time feed is that what we talkin about when we first sign up all When i purchase the pack? also can i use other pack combinations with other but no original sound from me just pack combined woth pack are they ok to be released?

  2. What do I need to consider when I go about copyrighting the work I’ve done that involves material from loopmasters? Do I need to copyright my work as derivative, or do I just copyright it like I would normally copyright work that doesn’t contain any sampled material?

    • I am not qualified to provide legal advice. I will therefore defer to what Loopmasters states as it terms of usage

You may use the sounds in combination with other sounds within your musical compositions. You may release such compositions commercially without payment of any further fees or royalties for such usage. For example, if you are the original purchaser of a sample CD, and you used sounds from it to create the soundtrack of a television commercial, simply by combining a synth loop sample with a guitar loop, and the TV advert was broadcast hundreds of times, you would keep all the royalties that the advert earns you, because you already purchased a private license to use the sounds commercially.
You cannot use the sounds in isolation (i.e. when not within musical compositions) as part of a commercially released project – for instance you cannot use the sounds to make another sample CD, or for sound effects on a website or multimedia production – unless as part of a composition with other sounds.

How I read this is if you use the loop in conjunction with your own creative work you can copyright as your own work. However you cannot just use the sound by itself.

  3. I appreciate the article as a new rookie EDM producer. I had one question regarding copyright infringement.

If one artist used the same royalty free vocal sample as me in his or her song, would it be considered copyright infringement if I released my track after them? I altered the vocal sample slightly, so it is not used in the same manner as the other artist. Just trying to understand the legality of it all.

    Thank you!

    • For the most part the royalty free loops do not have an elusive license. This means that several artist can use the same loop. When you purchase a license for a loop, Loopmasters who is the copyright owner, is giving the user permission to use the loop in their creative works. The only copyright infringement would be failure to purchase the proper license. It is best to read the license before making a purchase.

  4. Hello, is that mean that if the loops/samples are 100% Royalty Free, i could use them in my original productions (after i bought the pack of the samples) and i can get released my track on a label?

  5. Law Library. What constitutes a “sample” of music (free for commercial use), in time? Can a sample be taken from anything recorded and used commercially without owing a royalty, and if so, what are the rules?

  6. I play piano and guitar very well and can create complete tracks myself, as a songwriter 1st and producer 2nd I get inspired by just a very basic acoustic guitar chord progression and make it into a great production by using a mixture of sample loops and my own playing, I think you also become a much better musician as you are playing along with great musicians. as a songwriter it makes the process faster.

Also a lot of young artists writers depend apon producers to give them the backing tracks so they can write a song over it, I use loops to this advantage, I might only find 1 loop on a sample CD that is worth writing to, but when I find it, it really works.

Also , I write in all genres R&B, Dance , Pop , Country.

When I write country I am not able to perform all the parts like fiddle, banjo, or pedal steel, so loops is a must, but I do also try and play multi-samples of these instruments, when it gets too hard I look for loops, there are companies in Nashville that charge a lot of money to create a production for you so whats the difference , in the end a lot of the loops can be removed and real musicians brought in to do the final production. How many ways can you play G,C and D

  7. I found this information to be quite informative. I learned many things. I had no knowledge of this information prior to viewing your site. I thank you for what I perceive to be pertinent information regarding this subject.

  8. Greetings

Does royalty free mean there is no payments whatsoever and i can use a ‘royalty free’ sample however i please and not have to pay ?

    • Royalty Free is where you purchase a license for the specific asset. That license allow you to use the music according to that license. The license is in place of a royalty. A royalty is perpetual, the royalty free license is a one time fee with no future royalties paid to the publisher or artist. 9. I love music and computer music.
The questions I have are very, very,
Important to my music making dreams.
After having a stroke I’m not able to play my instrument
which are drums.but finding computer music is the best way for
me to keep going! Is it cheating to use all loops &my samples
To create music???? I have some people tell me if I can’t play it,
You are using someone elses creative mind to make music.
    IS THIS CHEATING!!!!

    • Personally, I don’t think that this is cheating. Creativity and art comes from new combination of elements to create something new. Loops and samples provide a musical pallet that you can use to create a new songs. Being a drummer you could also compose your own beats using a sequencer. Samples can then be used to emulate the sound you want for a particular percussion instrument. You could even “build your own kit” by combining different drum packages.

    • No, because you need to fit and arrange the loops, fill in around them, warp, slice etc. and most producers add their own stuff etc. there is no shame in using loops.
